INHERENT RISK AND NEGLIGENCE
I understand and acknowledge that participation in Brain Waves Yoga classes and/or programs, as with participation in ALL physical exercise and social-emotional learning programs, carries inherent risks. These risks include, but are not limited to: common minor injuries such as strains, sprains, emotional distress; more serious, but rare injuries such as broken bones and head injury; and extremely rare but catastrophic injuries such as heart attacks, paralysis, and death. Property damage may also occur. These and other injuries sometime occur because of hazards or accidents such as slips, falls, improper use or failure of equipment, failure to follow instructions, and negligence by the participant, the instructor, hosting facility, Brain Waves Yoga, Jacqui Driscoll, or others.
MEDICAL CONSULT
I understand that before undertaking Brain Waves Yoga classes and/or programs it may be prudent to consult a physician as to the appropriateness of the proposed activities.
NOT A SUBSTITUTE FOR MEDICAL CARE
I, the undersigned, understand that yoga, exercise classes, mindfulness, meditation, and group psychoeducation are not substitutes for medical attention, examination, diagnosis, or treatment.
ABILITY TO PARTICIPATE
I am able to undertake the yoga, exercise classes, meditation, and group psychoeducation exercises and related activities that are provided. I understand that if my condition changes it is my responsibility to no longer participate in the classes and/or programs.
SELF ASSESSMENT, PAIN, AND STOPPING
I understand that I must judge my own capacities. If I experience any pain or discomfort, I will take breaks and/or stop.
NON REFUNDABLE
I understand that my registration fee is non-refundable.
MEDIATION
I agree that before filing any claim in court, I will attempt to resolve any dispute through mediation. The mediator will be mutually agreed upon by the parties.
INDEMNIFICATON
I, for myself, my heirs, assigns, and legal representatives, agree to release, hold harmless, and indemnify (including costs and attorney’s fees), to the fullest extent permitted by law, Brain Waves Yoga, Jacqui Driscoll, its directors, officers, employees, instructors, independent contractors, agents, and representatives, and their successors and signs, against any claim - INCLUDING NEGLIGENCE on the part of those being released - related to my participation in Brain Waves Yoga classes and/or programs.
LENGTH OF AGREEMENT
This Agreement is applicable for 1 year following the participant’s participation in Brain Waves Yoga classes and/or programs.

SEVERABILITY CLAUSE
If any part of this Statement is held to be invalid or legally unenforceable for any reason, the remainder of this provision shall not be affected thereby and shall remain valid and fully enforceable.
AGREEMENT TO ALL TERMS ABOVE
I HAVE CAREFULLY READ AND UNDERSTAND THE ABOVE WAIVER OF LIABILITY AGREEMENT.
I have carefully read the above waiver of liability and fully understand its terms. I am legally competent to sign and voluntarily agree to the terms and conditions stated above.
